• "Fitty", "we", "our", "us" refers to Fitty fitness studio, located at Mezzanine Floor, UW Mall Next to Burjuman, Al Mankhool, Dubai.
• "Services" refers to all fitness programs, training sessions, packages, in-home services, assessments, and any other services provided by Fitty.

• "User", "you", "your" refers to any individual accessing our website or using our services.

   

2. Use of Our Website

You agree to use our website only for lawful purposes and in accordance with these Terms. You must not:

• Use the website in any way that violates any applicable local, national, or international law or regulation
• Attempt to gain unauthorized access to any part of the website, server, or any database connected to the website
• Use the website to transmit any unsolicited or unauthorized advertising or promotional material

• Introduce any viruses, trojans, worms, or other harmful material to the website

   

3. Services and Packages

3.1 Service Description

Fitty offers personalized fitness programs including but not limited to Body Recomposition, Senior Fitness, Pre/Postnatal Fitness, Sport-Specific Training, Kids Strength & Nutrition, Hormonal Health, and Corporate Wellness programs. Service details, inclusions, and durations are as described on our website and may be updated from time to time.

3.2 Assessments

Certain programs require an initial assessment. You agree to provide accurate and complete health information during assessments. Fitty reserves the right to refuse or modify services based on assessment results to ensure your safety.

3.3 Package Duration and Validity

Packages are valid for the duration specified at the time of purchase. Unused sessions cannot be carried over beyond the package validity period unless otherwise agreed in writing. Package durations and inclusions are as listed on our website.

4. Booking and Cancellation

• Sessions must be booked in advance as per the scheduling policy
• .Cancellations must be made at least 24 hours before the scheduled session. Late cancellations or no-shows may result in the session being counted as used.

• Fitty reserves the right to cancel or reschedule sessions due to unforeseen circumstances, with reasonable notice provided.

   

5. Payment Terms

• All prices are listed in AED and are inclusive of applicable taxes unless stated otherwise.
• Payment is required in full at the time of purchase unless an installment plan has been agreed upon.

• Refunds are processed on a case-by-case basis. Unused sessions may be eligible for a partial refund, subject to our refund policy.

   

6. Health and Safety

By using our services, you acknowledge and agree that:

• You are in good physical health and have no medical conditions that would prevent you from participating in fitness activities, or you have obtained medical clearance to do so.
• You will inform your trainer of any injuries, health conditions, or changes in your physical condition.
• Physical exercise carries inherent risks, and you participate at your own risk.

• For minors participating in our Kids programs, a parent or legal guardian must provide written consent and is responsible for disclosing any relevant health information.

   

7. Intellectual Property

All content on our website, including text, images, logos, graphics, videos, and software, is the property of Fitty and is protected by copyright and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission.

8. Contact Form and Callback Requests

When you submit a contact form or callback request through our website:

• You consent to us collecting and storing the information you provide (name, email, phone number, service preferences, and message).
• You consent to receiving a confirmation email acknowledging your submission.
• You agree that the information you provide is accurate and complete.

• Your data will be handled in accordance with our Privacy Policy.

To the fullest extent permitted by law, Fitty shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our website or services. Our total liability for any claim arising from our services shall not exceed the amount paid by you for the specific service giving rise to the claim.

10. In-Home Services

For In-Home Service packages, additional terms apply:

• You must provide a safe and suitable space for training at your location.
• Fitty is not liable for any damage to your property during in-home sessions unless caused by gross negligence.

• Travel time and equipment logistics are included in the service as specified in your package.

   

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Dubai.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after any changes constitutes acceptance of the updated Terms.
